On Wednesday, November 25, the Fullerton City Council met at 8:00 a.m. for a Special Meeting to announce a settlement in the civil lawsuit brought by Ron Thomas, father of schizophrenic Kelly Thomas, beaten into brain death by members of the Fullerton Police Department four and half years ago. The council had already met in a closed session meeting two days earlier on Monday, November 23 to decide whether or not to settle the case, scheduled to begin that very morning in a Santa Ana courtroom. Council members Jan Flory, Doug Chaffee, and Mayor Pro Tem Jennifer Fitzgerald voted in favor of the settlement, while Mayor Greg Sebourn and Council member Bruce Whitaker voted against it.
Although video of the November 23 meeting is available on the city’s website, along with other archived videos of past meetings, no such video can be found there of the Nov. 25 meeting. CORRECTION: The November 23 meeting was not recorded either, even though several members of the public offered comments prior to the council retreating into Closed Session. When pressed for an answer about the video’s absence by Parks and Recreation Commissioner Barry Levinson during public comments at the regularly scheduled December 1 City Council meeting, City Clerk Lucinda Williams responded that the city’s contract only covered regular meetings, and that a special call needed to have been made to arrange for the video recording of special meetings, and that that call had not been made ahead of the November 25 meeting.
The timing of the November 25 meeting was already suspect. Rather than wait until the regularly scheduled December 1 evening meeting, which would be both video recorded and broadcast live, to announce the expensive and embarrassing settlement, a Special Meeting was quickly scheduled early in the morning on a weekday, the day before the Thanksgiving holiday break. There is no logical reason for not video recording the November 25 session, which was a pubic announcement. Although a complete recording of that meeting is not known to exist, the Fullerton Rag does have five videos shot from the audience to preserve parts of the proceedings. Below are the announcement of the settlement by City Attorney Richard Jones, along with explanations by four council members of their respective support or opposition to the decision (Council member Jan Flory was not present for the November 25 meeting). Frankly, I’m disappointed, disgusted and done. There is no point to keep rehashing this.
We know what Fullerton PD did and we know what they got away with.
We protested and we fought hard for change. We tried to right the wrongs. We made a little progress but it was at least some.
Those of us who are parents hope to never bury our children. We damn sure hope to never be in Kelly’s parents’ shoes.
Do I believe Kelly’s death hurt Ron? Yes I do. I saw it in his eyes.
Do I believe the hearing was about money? Yes I do. From the many things that Ron said at the beginning to what he said at the end. He believed it was a 50-50 shot with the jury so it was better to settle than risk losing and not getting an admission of liability.
There is still no admission of liability. The city was quite clear in their statement that settling is by no means an admission of any liability. The only risk Ron Thomas would’ve taken by letting this case go to trial was to lose money that he hoped to win. Even after he said no amount of money would make him settle.
Way back when, he said that after helping his family, trial winnings would go to help those like Kelly. Then at one of the recall/election celebrations, he announced he’d be richer than Tony Bushala and would buy a home in Fullerton, have it become incorporated so he could run for Mayor and really fix Fullerton. I suspect we won’t really see much him at all anymore.
Who really lost? Kelly never truly got justice. His mom, Cathy, still quietly helps with the homeless and needy. They’re treated a little better because of what happened to him. People are still ready and willing to step up when they see FPD, the city or private establishments discriminating against someone based on their empty pockets or dire situation.
We can’t change or fix the past. It’s time to pick up and move on. We’ll never forget Kelly Thomas. Now that all legal matters are settled, we should be pushing the city for that bench in his honor at Kelly’s Corner.
Kelly’s Corner must also remain permanent. It’s become a place of hope, where we can take food, clothing, etc.
Moving on doesn’t mean forgetting.

I think that Fullerton residents should find this tape of former Fullerton Mayor, Pam Keller, trying to bully and harass a lone Fullerton resident who is video recording the Kelly Tomas settlement conference VERY disturbing.
I wonder if since they’ve actually got a video of this if Sharon and Rusty Kennedy’s Fullerton Observer will be reporting about their favorite daughter’s latest and greatest bullying ways in their next edition?
Maybe they should make it front page news like they did with Barry Levinson?

Why does it take a blind, deaf, and dumb, individual to point out to Fullerton residents what’s REALLY going on with NUFF and their ties to the Fullerton Observer.
Neighbors United For Fullerton or NUFF is a local political group who professes to be non-partisan, which Webster’s dictionary defines as: especially : free from party affiliation, bias, or designation. I have done a little of my own research into just who and what NUFF is, and have come to far different conclusions about who and what NUFF REALLY is.
Consider first that the Fullerton Observer, who also professes to be non-partisan, has a long time political commentator that pontificates about local politicians, “Vince” Buck, is a NUFF member. Who else are NUFF members? You would think with a name like “Neighbors United For Fullerton” that this would be a group of neighbors who hoped that their collective voices would be better heard, yet in reality, I noticed that most, if not all, off the names that I’ve found ran through the state of California’s “Transparent California” website, have come back showing NUFF members as Teachers and Professors that advocate for candidates in local elections that will give them generous raises and retirement packages, for sub-par Teachers and Professors.

I think that it’s also noteworthy to see how the Fullerton Observer’s editor, Sharon Kennedy, perjures herself under oath in this Superior Court declaration , by stating that the Fullerton Observer is non-partisan, and non-sectarian.
I’ll grant them the last one, but the first is a blatant lie as the Fullerton Observer’s definitely supportive with their coverage of Democratic candidates, such as Chaffee, Sharon Quirk Silva and Pam Keller, and obviously slanted in their coverage of Republicans such as Norby, Nelson, Whitaker, and even Chris Thompson.

I never said that the city council hires university professors.
What I said is, is that NUFF is being disingenuous by being comprised of mostly retired educator calling themselves “Neighbors United” and misleading by saying that non-partisan and/or neighbors when they are 100% aligned with the Democratic party, and also espousing the party’s agenda through candidates like Sharon Quirk/Silva, Pam Keller, Doug Chaffee, and Jan Flory.

They’re mostly Democrats, but they did endorse Rick Alvarez in the last election, which should tell you all you need to know about their group wisdom in an election season. They also have that guy from Chevron as a member. It’s not like they have much money to hand out anyway. On the plus side, they hold forums on public issues every other month or so. I guess anyone can call themselves “neighbors” and be active politically, and more people should.

You sort of make my point for me, where I’m questioning why a local group with not much money on hand, like NUFF would choose to spend the lion’s share of their group’s balance sheet with a $2,500 political donation to Pam Keller’s bid for city council in 2006?
It’s located right next to the donation from the city of Fullerton public worker’s union.

Who other than Pam Keller’s kisser have you ever seen on the front page of the Fullerton Observer, in a feature that is usually relegated to the end of the paper?
Do you think Sharon Kennedy or Vince Buck would honestly allow Pam Keller to be seen with anything on in public other than a halo?
I honestly don’t expect to hear it even mentioned in the Fullerton Observer, and if it is, it’ll probably be along the lines that Barry Levinson set the whole thing up to make Pam Keller look bad.
We all know that Joe wisely tapes all of the shenanigans that go on at City Hall and I think they’re tiring of being exposed.
